BEFORE THEY COME: LEGAL, DIGITAL & EMERGENCY PREP

Follow these practical strategies to help you prepare if you are targeted. It includes forms, checklists, emergency planning templates, and Know Your Rights for various scenarios.
- If you are undocumented, a visa holder, or have DACA, TPS, asylum, or a green card—and believe you may be at risk—it is critical to secure legal representation now, before a crisis hits. Waiting until you're already targeted can limit your options and delay protection.
- Your online presence can be used against you. Protect yourself by following our digital security guide, locking down your accounts, and limiting what you share—before unwanted attention turns into surveillance or targeting.
PREPARE AHEAD OF TIME
Create an Emergency Plan by completing these documents
- [ ] Emergency Contact Form (fill out and share with trusted contacts).
- [ ] FOR NON-CITIZENS — FORMS TO PRE-SIGN & KEEP WITH ATTORNEY:
- [ ] **FORM G-28** - Informs the U.S. Department Of Homeland Security (DHS) of your legal representation and allows the DHS to communicate with your attorney regarding any immigration matter involving you.
- [ ] **ICE FORM 60-001** - Gives consent to ICE to disclose information to 3rd Party (usually elected representative). For advocacy purposes only - DO NOT SIGN BEFORE SPEAKING TO AN ATTORNEY.
- [ ] Create a personal Emergency Protocol and **Media Protocol,** and share them with trusted contacts.
- [ ] Review and design a family action plan.
- [ ] Make a plan for your pets, including food, care and possible temporary caregivers.
Secure Your Digital Presence
- [ ] Complete the Digital Security 101 checklist for device safety & digital security.
- [ ] Make accounts private and limit public posts.
- [ ] Ask the Duke Rapid Response team for help in your intake if digital safety feels overwhelming.
Track Your Immigration Status (if applicable)
- Student visa holders: Regularly confirm your SEVIS status with **Duke Visa Services.**
- Undocumented: Carry proof you’ve lived in the U.S. for 2+ years (e.g. utility bills, leases) to help fight expedited removal.
- Visa/Green Card/Asylum Holders:
- Carry photocopies (not originals) of your U.S.-issued immigration documents (e.g., visa, Green Card).
- Keep foreign passports secured at home—not on your person. Make sure trusted family or contacts know where it is.
- U.S. Citizens: Some lawyers now advise Black, Brown, and Muslim citizens to carry ID or a passport photocopy due to profiling. This is optional based on comfort.
TOP PRIORITIES: LEGAL SAFETY & IMMEDIATE RESPONSE
FORMS OF REPRESSION:
- State: ICE raids, immigration law weaponization, "material support for terrorism" laws.
- Campus: Investigations via OIE, conduct sanctions, PPD violations, union suppression, employment threats.
WHAT TO DO IF TARGETED BY:
ICE OR LAW ENFORCEMENT
- STAY SILENT! ONLY respond to questions with: "I do not consent to a search/entry" and "I am exercising my right to remain silent."
- Do NOT open the door without a judicial warrant.
- Do not give false information to law enforcement.
- Record the incident if it’s safe to do so.
- Avoid sharing sensitive info online or on the phone.
CAMPUS INVESTIGATIONS
- Non-tenure-track faculty: Document everything, contact your union rep, Local 26 S.E.I.U. Southern Region, contact **Duke AAUP,** and contact **Pal Legal.**
- Tenured faculty: Contact **Duke AAUP.**
- Students: If contacted by OIE/Student Conduct, submit a Pal Legal intake immediately and request a support rep for interviews.
- PhD workers: Document everything, contact your union rep or steward (DGSU), and contact Pal Legal, contact SEIU’s legal hotline for visa related emergencies: 888-416-2110.
- Staff: For unionized staff, contact your union rep or steward; yet-to-be unionized staff will be on a case-by-case basis to institutional support.
